The Indian authorities have won a major victory in a British court in the extradition case of fugitive diamond trader Nirav Modi. Nirav Modi has lost his case against extradition. At present, the court has referred the matter to the home secretary there. Further conditions will depend on their approval. At present, it can get two months time for this. The Ministry of External Affairs responded in the matter saying that Nirav Modi is wanted in India in the Punjab National Bank fraud case. His extradition to Britain was sought in August 2018 at the request of CBI and ED.
Spokesperson Anurag Shrivastava said that on March 20, 2019, Nirav was arrested in Westminster Magistrate’s court before a senior district judge. He has since been facing extradition proceedings while in judicial custody. The Foreign Ministry stated that the final hearing in this case was held on 7-8 January 2021. The spokesman said that the Westminster Magistrate’s court in London has ruled on Thursday. Citing the order, the spokesman said that the judge said that Nirav Modi conspired to destroy the evidence and intimidate the witnesses. The Westminster magistrate’s court has recommended the extradition of Nirav Modi to the UK Home Secretary, so the Indian government will liaise with UK authorities for extradition.
To avoid the extradition of Nirav’s maneuvers , Nirav Modi told the court that he is mentally ill. He also claimed to not have facilities in India’s jail. Her lawyers said the matter is disputed. Nirav Modi has been wrongly accused.
The court’s strictness
dismissed the Nirav’s mental health concerns. Said that if Nirav is sent to India then there is no risk of his suicide as he will get proper medical help in Arthur Road Jail. The court admitted that Nirav Modi had conspired to destroy evidence and intimidate the witnesses.

Nirav Modi is lodged in London’s Wandsworth Jail. Following the decision of Judge Samuel Gooji in the London Court, the case will now go to the UK Home Ministry. Home Minister Preeti Patel will put her final stamp on the court’s decision on extradition. After this, the process of bringing this wanted fugitive from India to Mumbai Jail will begin. However, he is unlikely to visit India immediately. After the court verdict, Nirav Modi will have the option of going to the upper court. He can appeal in the High Court against the verdict. Nirav has 28 days to appeal. After a setback from the High Court, he can go to the Human Rights Court. In addition to this he will have the option of going to European court talking about human rights.
