The Aam Aadmi Party (AAP) has approached all opposition and non-NDA parties in the Rajya Sabha to oppose the National Capital Territory of Delhi Government (Amendment) Bill, 2021 (GNCTD Bill 2021).
Party sources said, ‘AAP’ on Tuesday requested all opposition parties to oppose the GNCT bill in the Rajya Sabha, which says that “Government” in Delhi means “Lieutenant Governor”. He further said that most of the opposition parties have supported AAP’s stand against this bill and will raise their voice against it.
AAP’s Rajya Sabha MP Sanjay Singh said on Tuesday that the Congress, Rashtriya Janata Dal, Samajwadi Party, Nationalist Congress Party, Shiv Sena and DMK are with the Aam Aadmi Party over the National Capital Territory Government (Amendment) Bill, 2021 and in the Rajya Sabha. Will oppose this bill.
The National Capital Territory of Delhi Government (Amendment) Bill, 2021 was passed in the Lok Sabha on Monday amid strong opposition from Congress and AAP. The AAP called the bill “unconstitutional”. The passing of this bill makes it mandatory for the Delhi government to seek the opinion of LG before taking any executive action. The AAP is in power in Delhi.
Kejriwal told the bill an insult to the public
Delhi Chief Minister Arvind Kejriwal on Monday called the ‘National Capital Territory Governance (Amendment) Bill 2021’ passed in the Lok Sabha as an insult to the people of the national capital. Kejriwal said that the bill effectively takes away the power from those whom the people have voted for and empowers those whom the people have defeated.
GNCTD bill passed from Lok Sabha
The Lok Sabha passed the ‘Delhi National Capital Territory Governance (Amendment) Bill, 2021’ giving greater powers to the Lieutenant Governor in Delhi on Monday. The bill defines certain roles and rights of the Lieutenant Governor (LG).
Responding to the discussion on the bill, Minister of State for Home Affairs Kishan Reddy had said that as per the constitution, Delhi is a Union Territory with limited powers consisting of Legislative Assembly. The Supreme Court has also said in its judgment that it is a Union Territory. All amendments conform to the decision of the court. He had said that this bill has been brought for certain clarifications, which will benefit the people of Delhi and bring transparency. He further said that it was not brought from a political point of view and for technical reasons so that there would not be any confusion. Following the Minister’s reply, the Lok Sabha approved the National Capital Territory Government (Amendment) Bill 2021 by voice.
The center gave this reasoning behind bringing the bill
The Minister of State for Home said that till December 2013, the rule of Delhi ran smoothly and all matters were resolved through negotiation, but in the last few years, the High Court had to go to the Supreme Court regarding the subjects because someone with some rights There was no clarity. Reddy said that the Supreme Court in its judgment said that it is mandatory to inform the Lieutenant Governor about the decision of the cabinet, the agenda. He said that some topics need some clarification. In the absence of these, the people of Delhi are being affected. The development of Delhi is also affected. It is necessary that administrative ambiguities are eliminated so that the people of Delhi can get better administration. Reddy had said that Delhi is a union territory with an assembly. It should be understood by all that it has limited powers. It cannot be compared to any other state.
He had said that no rights are being taken away from anyone through this bill. It is already clear that the President appoints the Lieutenant Governor of Delhi as the Administrator of the Union Territory. If there is a difference of opinion, then the subject can be referred to the President. According to the objectives and reasons of the bill, in the context of the legislation passed in the Delhi Legislative Assembly in this bill, the Government will have the meaning of Lt. Governor of National Capital Territory of Delhi. In this, the position of Delhi will be in the Union Territory so that ambiguities in the election of legislative provisions can be noted. A sub-section will be added to section 21 in this regard.
It added that the bill also proposes to ensure that the Lieutenant Governor must be given the opportunity to exercise the power entrusted to him under clause 4 of Article 239A of the Constitution in the selected category in cases. The objectives of the bill states that the said bill will promote cordial relations between the legislature and the executive and define the responsibilities of the elected government and governors in accordance with the constitutional scheme of governance of the National Capital Territory of Delhi.
